Lou’s Rewards Program Terms & Conditions
Effective: November 20, 2024 (“Effective Date”)
WELCOME TO LOU MALNATI’S REWARDS! THESE TERMS AND CONDITIONS EXPLAIN HOW YOU CAN EARN POINTS THROUGH THE REWARDS PROGRAM.
LOU MALNATI’S IS MAKING EXCITING CHANGES TO ITS REWARDS PROGRAM AS OF THE EFFECTIVE DATE ABOVE. SEE BELOW A SUMMARY OF SOME OF THE IMPORTANT CHANGES BEING IMPLEMENTED.
- On the Effective Date, Lou Malnati’s is excited to announce that they will provide Members with a one-time gift equal to 750 Points. These specific Points must be redeemed for a Reward within forty-five (45) days of the Effective Date, and will expire thereafter.
- On the Effective Date, $1 spent on a Qualifying Purchase = ten (10) Points.
- All current Point totals will be carried over and multiplied by ten (10). For example, if a Member has five hundred (500) points as of the Effective Date, the Member will now have 5,000 Points.
- For new Members, Points will start being earned after you create your Account and make your first Qualifying Purchase.
- Points will expire, and your Account may be terminated, after one hundred and eighty-(180) days without a Qualifying Purchase.
- Once you earn 10,000 or more Points, you will be unable to earn any more Points from Qualifying Purchases or through any other methods until your Point total is under 10,000.
- If you earned 10,000 or more Points prior to the Effective Date, your current balance will be multiplied by ten (10), and you will be unable to earn any more Points from Qualifying Purchases or through any other methods until your Point total is under 10,000. For those Members who have over 10,000 Points as of June 30, 2025, all Points over 10,000 will expire on June 30, 2025, and you will be unable to use such excess Points, and your Point balance will be reduced as needed to equal 10,000 on July 1, 2025.
- When a Member redeems Points for a Reward, the Reward will be available for redemption for thirty (30) days. Thereafter, the Reward will expire, and may no longer be used by the Member, and the Points used to redeem the Reward will not be added back to your Account.
By joining the Rewards Program (“Program”), you agree to be bound by these Terms and Conditions (“Terms”).
YOU ACKNOWLEDGE AND AGREE THAT LOU MALNATI’S RESERVES THE RIGHT TO, AT ANY TIME, WITH OR WITHOUT ANY NOTICE OR FURTHER OBLIGATION TO YOU: (A) UPDATE, MODIFY, CANCEL OR TERMINATE THE PROGRAM, (B) UPDATE, MODIFY, CANCEL, OR TERMINATE ANY FEATURE OF THE PROGRAM (INCLUDING, BUT NOT LIMITED TO, HOW POINTS ARE EARNED, HOW REWARDS ARE REDEEMED, AND THE TIME PERIOD IN WHICH THE POINTS AND REWARDS EXPIRE), AND (C) UPDATE, MODIFY, CANCEL, OR TERMINATE THESE TERMS. MEMBERS WAIVE ANY RIGHT TO RECEIVE NOTICE OF SUCH CHANGES OR MODIFICATIONS, AND A MEMBER’S CONTINUED ACCESS TO OR PARTICIPATION IN REWARDS PROGRAM FOLLOWING ANY CHANGES OR MODIFICATIONS CONFIRMS THE MEMBER’S ACCEPTANCE. IF THE MEMBER DOES NOT AGREE TO THESE TERMS, HE/SHE MUST STOP ACCESSING AND PARTICIPATING IN LOU MALNATI’S REWARDS. YOUR CONTINUED PARTICIPATION IN THE PROGRAM, INCLUDING USE OF A MEMBER ACCOUNT OR POINTS, INDICATES ACCEPTANCE OF THESE TERMS. IT IS YOUR RESPONSIBILITY TO CHECK THE TERMS TO SEE IF THEY HAVE CHANGED (AND WHEN WE HAVE DONE SO, WE WILL ADJUST THE EFFECTIVE DATE).
The Lou Malnati’s Privacy Policy applies to this Program and your Account. In the event of any conflict between any details contained in these Terms and details contained in other marketing materials, the details of the Program as set forth in these Terms shall prevail.
BY CREATING AN ACCOUNT AND ENROLLING IN THE PROGRAM, YOU AGREE THAT: (1) YOU HAVE READ, UNDERSTOOD, ACCEPT, AND AGREE TO ABIDE BY THESE TERMS; (2) YOU ARE ELIGIBLE FOR PARTICIPATION; AND (3) AS APPLICABLE, CONSENT TO THE SPONSOR’S PROCESSING OF ANY AND ALL DATA THAT IS PERSONAL TO YOU, AND THE DISCLOSURE OF SUCH DATA TO THIRD PARTIES, IN ACCORDANCE WITH THE LOU MALNATI’S PRIVACY POLICY. IF YOU REQUIRE CLARIFICATION OR FURTHER INFORMATION REGARDING THE PROGRAM OR THESE TERMS, PLEASE SEND AN EMAIL TO US USING THE CONTACT US LINK AT HTTPS://WWW.LOUMALNATIS.COM/CONTACT.
IMPORTANT: YOU UNDERSTAND AND ACKNOWLEDGE THAT THESE TERMS CONTAIN AN ARBITRATION AGREEMENT, JURY AND CLASS ACTION WAIVERS, LIMITATIONS ON LOU MALNATI’S LIABILITY AND OTHER PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS REGARDING THE REWARDS PROGRAM. PLEASE CAREFULLY READ AND UNDERSTAND THESE TERMS.
IF YOU DO NOT AGREE TO THESE TERMS, PLEASE TERMINATE YOUR ACCOUNT AS SET FORTH BELOW OR DO NOT PARTICIPATE IN THE REWARDS PROGRAM.
A. ABOUT LOU’S REWARDS
Lou’s Rewards (the “Rewards Program” or “Program”) is a loyalty program sponsored by Lou Malnati’s Pizzeria (“Sponsor”) through which individuals (“Members”) who have an online ordering account (“Member Account” or “Account”) collect points (“Points”) by making Qualifying Purchases. Members may redeem their Points online or at any Lou Malnati’s location for select appetizers, desserts, salads, pizzas, and other items as determined by Lou Malnati’s in its sole discretion.
B. PRIVACY
All information submitted by Members in the Program will be treated according to Lou Malnati’s Privacy Policy. By registering and continuing to remain a Member, you agree to receive e-mail communications about the Program and other Lou Malnati’s offers and marketing communications. In addition, and during registration and at other times, you will be able to opt-in to receive text communications about the Program and other Lou Malnati’s offers and marketing communications. Members may rescind their registration in the Program by emailing [email protected] and requesting to cancel your membership. By opting-out of the Program, you will forfeit all accrued Points and any redeemed, but unused Rewards, and your Program Account will be deleted (your general Lou Malnati’s web account will not be deleted so you may continue to log in to LouMalnati’s.com and order from Lou Malnati’s).
C. ELIGIBILITY
You must be 18 years or older and a legal resident of the United States (including D.C.) (“Jurisdiction”) to participate in the Program. By creating an Account, you agree that you meet the eligibility criteria and that you will be bound by these Terms. Sponsor and its affiliates, and each of their employees, are not eligible to participate in the Program, and cannot earn or redeem Rewards.
Groups, clubs, organizations, businesses, and commercial and non-commercial entities cannot participate in the Program and are not eligible to create an Account or accrue Points.
D. PARTICIPATION IN THE PROGRAM
- By participating in the Rewards Program, Members fully and unconditionally agree to these Terms. Members that fail to comply with these Terms, based on the sole discretion of the Sponsor, can be: 1) prohibited from participating in the Program and 2) will have all Points and redeemed, but unused Rewards subject to forfeiture without compensation.
- To enroll in the Program, Members must create an Account. An Account can be created by downloading the Lou Malnati’s Loyalty Application https://www.loumalnatis.com/blog/lou-malnatis-app-here/ or by creating an Account via the following link order.loumalnatis.com.
- Subscribers can opt-in for SMS messages from Lou Malnati's as a part of the loyalty registration process at https://www.loumalnatis.com/rewards. By doing so, you agree to receive automated promotional and personalized marketing text messages from Lou Malnati's to the mobile phone number you provided when signing up. Messages may pertain to promotional programs, new menu items, etc. Messages for this program will be sent from (312) 667-1824 and begin with Lou Malnati's. Consent to receive automated marketing messages is not a condition of any purchase. Message frequency varies. Message and Data rates may apply.
- To opt-out of the text messaging program, text the keyword STOP to (312) 667-1824 to cancel. After texting STOP to (312) 667-1824 you will receive one additional message confirming that your request has been processed. For more information, text the keyword HELP to (312) 667-1824 for customer care information. You can also contact us at [email protected] or (847) 562-1814 for additional assistance.
- There is a limit of one Account per person regardless of whether more than one person uses the same e-mail address. The Program reserves the right to delete Accounts without compensation for Members that are found to maintain duplicate Accounts. Prior to deleting, the Program will contact the Member to offer an opportunity to merge Accounts. If Members need to merge a duplicate Account, please contact the Sponsor at [email protected].
- Members are responsible for maintaining accurate contact information in their Account.
- Subscribers can opt-in for SMS messages from Lou Malnati's as a part of the loyalty registration process at https://www.loumalnatis.com/rewards. By doing so, you agree to receive automated promotional and personalized marketing text messages from Lou Malnati's to the mobile phone number you provided when signing up. E. COLLECTING POINTS
- Points can be collected by making Qualifying Purchases at Lou Malnati’s stores or orders placed directly through Lou Malnati’s ordering channels (such as the Lou Malnati’s Loyalty Application, dining in, ordering over the phone or order.loumalnatis.com) (each a “Qualifying Purchase”). No Points are earned for purchases made through third-party ordering platforms (such as UberEats or DoorDash) – you must place an order directly through the Lou Malnati’s Loyalty Application or order.loumalnatis.com.
- Members earn ten (10) Points per dollar spent on Qualifying Purchases including: dining in, carryout, or delivery purchases. Points are awarded based on the subtotal of the purchase, after any discounts have been applied, before tax, gratuity, and any applicable delivery fees, excluding the purchase of gift cards. Orders purchased with a gift card are eligible to receive Points. Points, however, are not earned by purchasing a gift card.
- Points will automatically be credited to the Members Account for purchases made in-store or through the Lou Malnati’s Loyalty Application or online at order.loumalnatis.com. To earn Points on an order by phone or dine in, the Member should simply mention that he/she is a Rewards Program Member and provide his/her name and phone number or email address, and the Member Account will be linked to the purchase.
- Members have seven (7) days from time of purchase to credit any Qualifying Purchases to their Member Account, if no Member Account is given at time of purchase. Members must manually enter the code online or they can scan the QR code located at the bottom of the purchase receipt.
- Only purchases paid directly by the Member Account holder should be credited to that Member’s Account. Members cannot split checks and accrue Points, only one Member Account is eligible per purchase. Members who violate this rule, based on the sole discretion of the Sponsor, can be: A) prohibited from participating in the Program; and B) will have all Points subject to forfeiture without compensation. Neither Sponsor nor its agents will be liable for any unaccredited or misdirected Points. Sponsor reserves the right to invalidate Points if it determines, in its sole discretion, that Points were improperly credited or obtained fraudulently, or in a manner not described herein.
- Points will not be awarded for any Tastes of Chicago orders.
- Points will not be awarded for catering orders.
- Points are not property, have no cash value, and are not redeemable for cash or credit. Further, any Rewards earned by a Member, including, but not limited to, any discount offers, have no cash value, and are not redeemable for cash or credit. Points are not transferable, for any reason. Points are only a measurement of a Participant’s eligible purchases and activities in the Program, and are not considered the property of the owner. Points are not redeemable for cash, check, or any other form of credit, and cannot be used to make a donation (except for eligible redemptions listed in the Rewards Gallery), pay for taxes, tips, or shipping and handling). Except as provided for in these Terms, Points earned in the Program are not assignable for any reason, and are not transferable between separate Accounts, without the express written consent of Sponsor. The sale of Points or Rewards and/or any potentially fraudulent action in connection with the Program is prohibited and may result in the forfeiture of your Points as well as termination of your Account. SPONSOR IS NOT RESPONSIBLE FOR ANY POINTS THAT CANNOT BE REDEEMED IN ACCORDANCE WITH THESE TERMS DUE TO RESTRICTIONS IMPOSED BY APPLICABLE LAWS.
F. REDEEMING POINTS FOR REWARDS
- Members may redeem Points for the rewards set forth below (“Rewards”) (provided the Members acknowledge and agree that the below Rewards are subject to change in Lou Malnati’s sole discretion and are subject to location availability):
- 750 Points: $5 off any Qualifying Purchase; Carol’s Cookies.
- 1,250 Points: Garlic Bread, Cheese Bread, Bruschetta, Tiramisu, Chocolate Obsessions.
- 1,750 Points: $10 off any Qualifying Purchase, Medium Salad, Medium Wings.
- 2,250 Points: $15 off any Qualifying Purchase, Small Deep-Dish pizza, Medium Thin Crust, Family Size Wings, Family Size Salads.
- 2,750 Points: Medium Deep-Dish Pizza, Large Thin Crust Pizza.
- 3,250 Points: Large Deep-Dish Pizza, XL Thin Crust.
- Pizza Rewards are valid for signature recipes (e.g., Chicago Classic, The Lou, etc.) or a create your own up to 2 toppings. Specialty crusts are included (e.g., gluten free, crustless, Buttercrust). Such terms and conditions may be subject to change by Lou Malnati’s.
- On the Effective Date, Lou Malnati’s will provide Members with a one-time gift equal to 750 Points. This gift will only be provided on those Members who have Accounts on the Effective Date. These specific Points must be redeemed for a Reward within forty-five (45) days of the Effective Date, and will expire thereafter.
- Any Members who sign up after the Effective Date will receive a Reward for one (1) personal deep-dish pizza or one (1) small thin crust pizza, which will expire within fourteen (14) days of issuance. This new Member Reward requires the Member to make a $10 purchase, and such new Member Reward may not be used otherwise. For clarity, this new Member Reward is subject to change or termination at anytime with or without notice to the Members.
- Reward redemptions, the types of Reward redemptions, and how many Points are needed for each Reward redemption, are subject to availability and may change at any time with or without notice to the Members. For clarity, Sponsor reserves the right to substitute a Reward with one of comparable or greater value for any reason and to change the Point value of any associated Reward at any time.
- Points may be redeemed for Rewards at the time a Qualifying Purchase is made. Points may also be redeemed for Rewards within your Account at any time.
- Members can redeem Rewards at any Lou Malnati’s location with no minimum purchase for dine-in, carryout, or delivery orders. Members can only redeem one Reward per transaction (Points will not be awarded to multiple Accounts for split checks, but Members may request separate checks so that each Member can earn Points on their individual check). Except as expressly stated otherwise, Rewards may not be combined with any other Sponsor offers or other Rewards or Points redemption attempts. Rewards cannot be redeemed via third-party ordering platforms.
- All Point redemptions are final, and Points will be deducted immediately from the Member’s Account.
- All redeemed, but unused Rewards will expire within thirty (30) days.
- From time to time, Sponsor may, in its sole discretion, elect to offer additional promotional opportunities for Members. Sponsor will provide the specific terms and conditions of any promotional offers at such time to which all Members shall be bound.
- Under the Program, Members are also eligible for one special birthday offer during their birthday month, once per calendar year. To receive the offer, the Member needs to have made at least one Qualifying Purchase in the last eleven (11) months, and Members should be sure their birthday is listed within their profile, and they are opted-in to receive emails. The birthday offer will expire thirty (30) days after the birthday offer is added to your Account.
G. POINTS CAP, EXPIRATION, AND ACCOUNT TERMINATION
- Once a Member accrues 10,000 Points, the Member’s Qualifying Purchases will NOT accrue any additional Points, until the Member’s Point balance is back under 10,000.
- If a Member accrued 10,000 or more Points prior to the Effective Date, the Member’s current balance will be multiplied by ten (10), and the Member will be unable to earn any more Points from Qualifying Purchases until the Member’s Point total is under 10,000. FOR THOSE MEMBERS WHO HAVE OVER 10,000 POINTS AS OF THE EFFECTIVE DATE, ALL POINTS OVER 10,000 WILL EXPIRE ON JUNE 30, 2025 AND YOU WILL BE UNABLE TO USE SUCH POINTS FOR ANY PURPOSE, AND YOUR POINT BALANCE WILL BE AUTOMATICALLY REDUCED TO 10,000 ON JULY 1, 2025.
- If a Member fails to make a Qualifying Purchase or redeem Points for 180 consecutive calendar days, all Points in his/her Account will be forfeited and will expire, without compensation or notice to you, and Sponsor also reserves the right to delete the applicable Member Account.
- You may Terminate your Account and your enrollment in the Program at any time by calling Lou Malnati’s Rewards, or by emailing [email protected] and request that our Customer Care Team cancel your membership. If you terminate your Account, all of your accrued Points will be forfeited (except as otherwise described in these Terms). Any Points remaining in a Member’s Account that has been terminated will be forfeited without compensation.
- SPONSOR RESERVES THE RIGHT TO IMPOSE OR REVISE EXPIRATION PERIODS OR DATES ON POINTS AND REWARDS THAT REMAIN UNUSED AS IT DETERMINES IN ITS SOLE DISCRETION, WITH OR WITHOUT NOTICE TO YOU.
H. ACCOUNT AND POINTS VERIFICATION
- You are responsible for ensuring the accuracy of your Account. If you believe your Account or Points balance is not accurate or a Points redemption, was incorrectly applied to your Account please contact [email protected] . Requests and inquiries must be received by Lou Malnati’s within thirty (30) days of the questioned activity. We may ask you to provide documentation to prove that you should have earned Points. For this reason, we recommend that you keep all receipts from a Qualifying Purchase until Points have been credited to your Account. If you are not able to provide the requested documentation, you may not be awarded any Points for your Qualifying Purchase. All decisions regarding Point balances, redemptions, and forfeitures, and the identity of the individual accessing an Account, are within Sponsor’s sole discretion and are final and binding.
- All Qualifying Purchases, Rewards redemptions and Members are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of purchase, identity and/or eligibility. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor, may result in disqualification in the sole and absolute discretion of the Sponsor. Sponsor may, in its sole discretion, determine the validity of any purchase, Qualifying Purchase or Reward and/or the eligibility of any Member.
I. MODIFICATION OR TERMINATION OF THE PROGRAM
- SPONSOR RESERVES THE RIGHT TO CHANGE, MODIFY, DISCONTINUE OR CANCEL THE LOU MALNATI’S REWARDS PROGRAM OR ANY PART OF THE LOU MALNATI’S REWARDS PROGRAM, AT ANY TIME AND IN ITS SOLE DISCRETION, WITHOUT NOTICE TO THE MEMBER. MEMBERS WAIVE ANY RIGHT TO RECEIVE NOTICE OF SUCH CHANGES OR MODIFICATIONS, AND A MEMBER’S CONTINUED ACCESS TO OR PARTICIPATION IN REWARDS PROGRAM FOLLOWING ANY CHANGES OR MODIFICATIONS CONFIRMS THE MEMBER’S ACCEPTANCE. IF THE MEMBER DOES NOT AGREE TO THESE TERMS, HE/SHE MUST STOP ACCESSING AND PARTICIPATING IN LOU MALNATI’S REWARDS. YOUR CONTINUED PARTICIPATION IN THE PROGRAM, INCLUDING USE OF A MEMBER ACCOUNT OR POINTS, INDICATES ACCEPTANCE OF THESE TERMS. IT IS YOUR RESPONSIBILITY TO CHECK THE TERMS TO SEE IF THEY HAVE CHANGED (AND WHEN WE HAVE DONE SO, WE WILL ADJUST THE EFFECTIVE DATE).
- If the Program is terminated, any Points remaining in a Member’s Account may be forfeited without compensation except as otherwise determined by Sponsor. Points may not carry over or transfer to other Sponsor programs (if any), unless otherwise determined by Sponsor in its discretion.
J. LIMITATION OF LIABILITY AND DISCLAIMERS
- BY PARTICIPATING IN THE PROGRAM, EACH MEMBER, ON BEHALF OF THEMSELVES, THEIR EXECUTORS, HEIRS, AND ASSIGNS ACCEPTS ALL RESPONSIBILITY FOR, AND HEREBY RELEASES AND AGREES TO INDEMNIFY AND HOLD HARMLESS THE SPONSOR, ITS PARENT, AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, SUPPLIERS AND ITS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS (COLLECTIVELY, THE “RELEASEES”) FROM AND AGAINST ANY AND ALL LIABILITIES, CLAIMS OR ACTIONS OF ANY KIND WHATSOEVER FOR INJURY, LOSS, DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION LOST PROFITS OR LOST SAVINGS), WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, THAT ARISES OUT OF, OR IS IN ANY WAY CONNECTED WITH, (A) ANY USE OF THE PROGRAM OR THE PROGRAM WEBSITE, INCLUDING BUT NOT LIMITED TO, PREPARING FOR, PARTICIPATING IN, OR TRAVELING TO AND/OR FROM USE OR MISUSE OF ANY REWARD OR QUALIFYING TRANSACTION, OR OWNERSHIP OF ANY REWARD; (B) ANY FAILURE OR DELAY BY SPONSOR IN CONNECTION WITH THE PROGRAM (INCLUDING WITHOUT LIMITATION, THE USE OF, OR INABILITY TO USE, PROGRAM WEBSITE AND ANY TYPOGRAPHICAL, PRINTING, MECHANICAL, NETWORK, ELECTRONIC, HUMAN, OR OTHER ERRORS, ERRORS THAT MAY OCCUR IN CONNECTION WITH THE ADMINISTRATION OF THE PROGRAM, THE REDEMPTION AND ACCRUAL OF POINTS OR REWARDS, THE INCORRECT PROCESSING OF POINTS, THE INCORRECT TABULATION OF POINTS, OR ANY INACCURATE OR INCORRECT DATA CONTAINED ON THE PROGRAM WEBSITE OR IN A MEMBER ACCOUNT; OR (C) THE PERFORMANCE OR NON-PERFORMANCE OF THE PROGRAM BY SPONSOR, EVEN IF MEMBER HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation, or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of a Member’s Account information, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action. Member accepts all responsibility for, and hereby indemnifies and holds Releasees harmless from and against, any actions taken by any user authorized to use a member’s account, including, but not limited to, accrual of Points, redemption of Points, and disclosure of passwords to third parties. Member agrees that all causes of action arising out of or connected with this Program shall be resolved individually, without resort to any form of class action. Nothing in this section is intended to limit Sponsor’s liability for damages to the extent caused by Sponsor’s own gross negligence or intentional or unlawful misconduct. Additionally, nothing in this section is intended to limit or alter your rights as a consumer that cannot be limited or altered under applicable law. Sponsor reserves all legal rights to recover damages or other compensation under these terms or as allowed by law.
- THE SPONSOR PROVIDES THE REWARDS PROGRAM AND RELATED SERVICES “AS-IS” AND WITHOUT ANY WARRANTIES. THE SPONSOR AND ITS AGENTS ARE NOT RESPONSIBLE FOR TECHNICAL, NETWORK, ELECTRONIC, COMPUTER, HARDWARE, OR SOFTWARE MALFUNCTIONS OF ANY KIND, OR INACCURATE TRANSMISSION OF PROGRAM INFORMATION DUE TO TECHNICAL PROBLEMS OR TRAFFIC CONGESTION ON THE INTERNET, AT ANY WEB SITE OR ANY COMBINATION THEREOF. YOUR SOLE REMEDY AGAINST THE SPONSOR AND ITS AGENTS FOR ANY DISSATISFACTION WITH THE PROGRAM OR THE RELATED ONLINE SERVICES IS TO STOP USING THEM. THIS LIMITATION OF RELIEF IS A PART OF THE BARGAIN BETWEEN THE PARTIES. THESE WARRANTY EXCLUSIONS MAY NOT APPLY TO YOU TO THE EXTENT THAT APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES.
- If Sponsor improperly denies a Member any Reward or any Points, liability will be limited to the equivalent fair market value of the Reward the Points. By participating in the Program, a Member waives any and all rights to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence upon which the claim or action is based.
- Additionally, nothing in this section is intended to limit or alter your rights as a consumer that cannot be limited or altered under applicable law. Sponsor reserves all legal rights to recover damages or other compensation under these terms or as allowed by law.
K. ARBITRATION
- Any dispute or claim arising out of or relating to these Terms, will be resolved by binding arbitration. The arbitration of any dispute or claim shall be conducted in accordance with the rules of the American Arbitration Association ("AAA"), including the AAA's Consumer Arbitration Rules (as applicable).
- The Member and Sponsor each agree that any proceeding will be conducted only on an individual basis and not in a class. If a court or arbitrator determines in an action between the Member and Sponsor that this class action waiver is unenforceable, the arbitration agreement will be void. If for any reason a claim proceeds in court rather than through arbitration, Member and Sponsor each waive any right to a jury trial.
L. GOVERNING LAW
Any dispute arising from these Terms or a Member’s access to or participation in Lou Malnati’s Rewards will be governed by and enforced in accordance with the laws of Illinois, without regard to conflict of law rules or principles. Each party agrees to submit to the personal jurisdiction of the state courts located in Cook County, Illinois, or the federal district courts located in the Northern District of Illinois and to accept service of process from them.
M. SEVERABILITY
If any provision or part of a provision of these Terms is unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
